The Government is the Enemy*

Dear pseudo-Americans in Congress,

I have two terms you should familiarize yourself with: Bill of Attainder & Ex Post Facto laws.

The Constitution of the United States, perhaps you've heard of it, expressly forbids both of these.

Bill of Attainder is singling out an individual or group and punishing them without trial.

Ex Post Facto laws are those passed after the fact...reaching back into the past, to make something illegal which was legal at the time it was done, creating criminal, punishable behavior where it never existed, and then punishing the actor as though he broke the law at the time of his actions.

Anyone with a brain in their head can see why the Founders outlawed these practices. If the government can do these things, no citizen is safe ever.

Yet, this is exactly what the Congress is trying very hard to do to the AIG executives. Both Bill of Attainder - singling them out for special persecution, and Ex Post Facto - time travelling to void what was a legal contract at the time it was signed.

I only hope the AIG execs have the balls to sue the shit out of Congress if they pass special laws to punish these particular individuals - without trial - and void perfectly legal, valid contracts. If they don't, we are all more at risk than ever from the out-of-control lynch mob formerly known as Congress.

If the AIG execs' contracts aren't valid, neither are any of yours. And if the government...or the party with whom you contracted, finds the terms inconvenient, they may seek to void the contract, because they can. And business as we know it, and the law as we know it, will end.

This is not the usual unintended consequence created by government boneheads. This is a direct assault on private citizens and time itself.

    As appealing as this sounds, it's just not legally possible. IIRC from sophomore Civics, the US guvmint cannot be sued without its permission.

    I fought the Law, and the Law ...
